3. The provisions of the preceding two paragraphs are not applicable to a
person who engaged in pilotage (including handling airframe systems and engines on board) on board the aircraft specified by Ordinances of the Ministry of Transport or a person engaged in the on board operations of aircraft of a new category, class or type for the purpose of test flights etc. under permission of the Minister of Transport.
(Conduct of Examination)
Article 29. The Minister of Transport shall, before issuing a certificate of competence, conduct examinations in order to determine whether an applicant has the aeronautical knowledge and aeronautical proficiency necessary for performing his air navigation services related to the qualification for which an application is submitted.
2. The examination shall consist of a written portion on aeronautical knowledge and a practical portion on aeronautical proficiency.
3. No person may take the practical portion unless he has first passed the written portion.
4. The Minister of Transport may, when issuing a competence certificate to a person who holds a qualification certificate for air navigation services issued by a foreign government, omit, in spite of the provisions of the preceding three paragraphs, the whole or a part of the examination in accordance with Ordinances of the Ministry of Transport.
The same applies to a person who has completed the course at a training facility, engaged in the teaching of professional aeronautical knowledge and proficiency, said facility being one of the education and training facilities specified by Cabinet Ordinances under the provisions of Article 3-(2), paragraph 1, No. 168 of the Ministry of Transport Establishment Law (Law No. 157 of 1949) or of an airman training school, approved, upon application, by the Minister of Transport.
(Change of Ratings on Competence Certificate)
Article 29-(2). The Minister of Transport may, with respect to a competence certificate on which a rating is indicated in accordance with paragraphs 2 or 3 of Article 25, change the rating upon application by an airman who already holds such a competence certificate.
2. The provisions of the preceding Article apply accordingly to the cases in which the ratings are changed.
